Summary of local conditions governing the use of pavement licences in Hart

Local conditions (applicable to ALL pavement licences)

  1. The Licence Holder is to use the highway solely for the purpose of the Pavement Licence and for no other purpose whatsoever.
  2. The Licence Holder shall be responsible for ensuring that the Premises Licence for the Sale of Alcohol issued by the Local Authority covers the area.
  3. The Licence Holder is to provide evidence that Hart District Council is indemnified against any claim arising from the operation of the facility by Public Liability Insurance cover of £5 million.
  4. A 1.5 metre clear walkway MUST always be maintained for the use of pedestrians.
  5. Clear access to the entrance of the premises MUST always be maintained.
  6. The Licence Holder shall ensure that any equipment used for the purposes of providing these facilities are safe and present no risk to members of the public and in particular:
    1. That all chairs, benches, and tables are in good repair and are stable.
    2. Any parasols and umbrellas are fully secured to the ground and weighted to prevent them being dislodged by the wind.
    3. The area to be used is protected and separated from the rest of the highway in such a way that a blind or visually impaired people, or those with learning difficulties or mobility difficulties, run no risk of injury from their use.
  7. Tables and chairs MUST NOT be sited to obscure visibility for road users.
  8. Furniture MUST NOT be placed in position on the highway outside the permitted times stated in the licence and MUST be kept within the agreed seating area.
  9. There must be NO signage or advertising media displayed in the agreed seating area.
  10. Tables and chairs MUST be cleared from the highway and stored securely when the business closes overnight; in times of darkness, adequate lighting must be provided.
  11. Tables and chairs MUST be sited so that they do not obstruct drainage outlets and access to utility apparatus must be maintained.
  12. At the instruction of Hart District Council or the highways authority (Hampshire County Council), the Licence Holder MUST remove the furniture during the licence period for the purpose of:
    1. Works in or under or over the highway or for using it in connection with works in, under or over land adjacent to or adjoining it as may be required by Hart District Council, the local highways authority or any statutory undertaker or;
    2. Any other reasonable cause or for use by emergency services.
  13. The licence-holder MUST NOT prevent statutory undertakers or electronic communications networks from having access to its apparatus under, in, on or over the highway.
  14. The area MUST always be kept clean and free from debris, and it shall be the responsibility of the Licensee to ensure that the area is clean and tidy.
  15. Where the Licence Holder makes provision for smokers, they MUST make reasonable provision for seating where smoking is not permitted.
  16. The Licence Holder MUST comply any Government guidance relating to COVID-19.
  17. NO tables, chairs or barriers may be placed in the area until a Pavement Licence has been approved.
