Purpose of processing

The Council is consulting on the issue of a PSPO on: 

  • Dog Fouling

The purpose of this consultation and the processing of your personal data is to inform the decision-making process for issue of a dog fouling PSPO

The Council’s legal basis for processing your data

The processing of this information is necessary for the Council to undertake a public task as defined under Article 6(1)(e) of the UK GDPR and has a clear basis in law namely Part 4, Chapter 2, Section 59 of the Anti-social Behaviour, Crime and Policing Act, 2014.

Personal data the Council will collect

The personal data the Council will collect from you includes:

  • Any personal data submitted with representations, your town or parish, organisation (where applicable), relation to the Hart District Area and dog-related employment. We discourage you from providing further personal data in your response.
  • Your Internet Protocol address, and details of which version of web browser you used.
  • Information on how you use the site, using cookies.

Who is collecting and using your personal data? 

Hart District Council is the data controller for the personal information you have provided for this purpose. 

How we use your information

Your information will be used to inform the decision-making process for issue of a dog fouling PSPO. This is a public consultation document.

Your data will allow us to identify what your views are in relation to the issue of the PSPO. This will allow us to inform appropriate decisions in relation to the establishment of the PSPO. 

Who the Council will share your data with

Only the Executive Director of Place, the Environmental Health Manager and relevant staff in the Environmental Health department will have access to the personal data. Elected officials will have access to an anonymised and aggregated report. 

We keep your personal data secure. We have internal policies and controls in place to ensure that your personal data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties. 

We will not share your personal data with any other parties except if required to do so by law.

How long the Council will keep your data?

Your personal data will be kept for four weeks after the implementation of the PSPO. Data will be accumulated into an anonymised and aggregated report which may be kept for longer to allow for an appeal period. 

The Council will only keep that data for longer if required to do so due to a legal challenge. In these circumstances your information will be kept for no longer than the duration of the legal challenge process. This would only be in the form of the aggregated report.
